A.5.32 Intellectual Property Rights
Control Objective
The organisation shall implement appropriate procedures to protect intellectual property rights.
Policy Statement
anDREa implements strict legal and operational safeguards to protect its own intellectual property (IP) and respect the intellectual property rights of third parties, including partners, open-source maintainers, and suppliers.
IP Protection Framework
Intellectual property rights, ownership, and usage constraints are formally defined and enforced across two primary pillars:
- Employment and Personnel Safeguards: Standard employee and contractor agreements contain explicit clauses governing the ownership of intellectual property created during the course of work. These clauses ensure that all proprietary code, architectures, and innovations developed for the myDRE platform remain the exclusive property of anDREa.
- Commercial and Customer Lifecycle: The usage rights, restrictions, and licensing parameters of anDREa's proprietary software are legally protected through commercial license agreements executed with customers and partners.
Administration & Cross-References
- Personnel Protections: Executed employment and subcontractor agreements are managed securely within anDREa People HR.
- Commercial Safeguards: Master service agreements and active commercial licensing terms are stored within the Customer Agreements.
